Because you are actually better off going through a more traditional dispute to get something off of your report completely when it was factually correct.....yet only wrong in specific detail on the report itself. How Long Does Credit Repair Take? The Straight Scoop on Fixing Your Credit Fast!

Does credit repair take a while? Days? Weeks? Months or years? If I start today...how long should I expect it will take? And is there a way to get it done FASTER if I need help quick? In this article we are going to take a quick and insightful look at how long credit repair takes...and see if there is anything you can do to speed it up if you need help in a jiff!

The truth about time and fixing your credit

Most conventional credit repair works in cycles. And those cycles are usually done in 30 day increments. For example, if you file your FIRST dispute on the 1st of the month, you really shouldn't expect to get a response until the 5th of the following month or thereabouts. Why? Because the FCRA (Fair Credit Reporting Act) and it's amendments generally allocate a "reasonable time" for the Credit Bureaus to investigate your dispute....which has been interpreted as 30 days. You have to allow for a little bit of mailing time as well, which in my experience is generally 5 days...which means I typically "budget" my disputes, from a time standpoint at 35 days for each.

Can some disputes be done FASTER?

Absolutely, yes. You can actually CALL the bureaus, and fax in documents in some situations, and if you have unequivocal PROOF that something should come off your report, or be changed to a new classification entirely, you can follow a very specific protocol, and they have 72 hours to fix your report. But it's important to use this sparingly....and ONLY when something is truly completely wrong, and not just wrong in detail. (like the amount you owed that was delinquent - in which case you'd want to use a more traditional dispute for a whole bunch of more strategic reasons..:-)

You CAN also expedite everything on your side...

With certified mailings and overnight mail when and where appropriate, and that will cut down on the time things take. But as always, you ARE subject to the schedule of the bureau's themselves, and often they CAN (and will be) the slow cog in the wheel...no matter how much we wish they moved faster! The good news is that each "round" of disputes tends to be about 30 days, and I've never seen anyone NOT be able to dramatically improve their credit in 6 months...and get an almost entirely NEW report in 12!

The traditional way of credit repair preaches financial discipline and paying your debt off. In reality paying your debt in full will not necessarily raise your score. For example, paying off an old collection might actually hurt your credit score. The reason is that the account is now updated to "current". The negative item (although paid) will have bigger impact on your credit score and will stay on your record as an adverse account for another 7 years. In this case-paying your debt in full doesn't really help. Instead of trying to pay debt in full, concentrate on negotiation with collection agencies. In reality debt collectors still make a pretty handsome profit even if you pay them 25 % or less of the amount owed. Your ultimate goal is to pay as little as possible and still convince debt collectors to remove the item from your credit report. In other words-don't go for the "hard" way, when you can do it the "smart" way.

3. Always aim for complete deletion.

Deletion of negative items is the ultimate goal of fast credit repair. A paid off negative item might not benefit your score. A deleted negative item, on the other hand, will boost your score immediately. In order to delete an item from your report, you have to master the art of "dispute" and " negotiation" with credit bureaus and collection agencies.

There are many ways to clean credit history. Knowledge about the inner workings of the system and the various loopholes in it, however, seems like the shortest route. Once you start thinking outside the box, you'll be surprised to find how easy credit repair actually is.

Christmas (yes I said the 'C' word -- Ho! Ho! Ho!) is just around the corner and consumer spending is once again at an all time high. For those of you that are struggling from the effects of bad credit the holiday season offers a small window of opportunity which, if acted upon, could open many possibilities for you in the New Year.

People often ask me why the holidays are the best time to repair their credit. Well, I have a theory. In preparation for the flood of holiday credit applications creditors shift gears and temporarily transfer dispute resolution staff to other divisions to handle the unusually high volume of new business. Being that the creditors make much more money increasing their customer base it seems understandable that they justify slacking off in the dispute department for a month or so each year. This temporary trend allows for your disputes to go unanswered which results in the items being deleted.

Another more obvious reason is that the holiday season is a time of vacation, cheer, forgiveness, charity and new beginnings. This combination tips the scales in your favor in a measurable way. It is common knowledge among credit professionals that this time of the year is perfect for disputing credit items on your credit report. The law states that if you dispute something on your credit report the credit bureaus have thirty days in which to verify that the item is valid or remove it. The vision of an understaffed creditor's office with phones ringing off the hook and overworked employees surfing the net for last minute gift comes to mind. Your chances are great.

Now comes the hard part. Where do you start? Allow me to point you in the right direction. While each major credit bureau (Experian, Equifax and TransUnion) has online disputing methods we have found them to be more trouble than they are worth, often taking hours to dredge through and providing dismal results when you do. Credit Repair - Time Limits For Credit Debt Reporting

Many years ago, I was informed I could not buy a new vehicle because my credit was shot. I was turned down despite possessing a solid position with a state government agency and a substantial cash down payment. I discovered that errors were being reported by creditors. I was also being dinged by my ex-wife's creditors although she was the primary card holder - and the primary spender.

However, this painful experience did not come without its hidden rewards. I was abruptly (and thankfully) introduced to the Fair Credit Billing Act of 1974 (HINT: Read this law).

Creditors love to play dirty, fast and loose. Their bottom line is to make money, even if they take a long walk outside the parameters of federal and state law. They figure what you don't know won't hurt them. That is about to change. My intention is to arm my beloved readers with information on how to fight back - and win!

Remember: knowledge is power and information is king.

First, forget about all those ads that ask you to give up your credit card information for free credit reports or credit monitoring. Most of them are scams - just another way to rip off the unsuspecting and uninformed consumer. By law, you are entitled to receive one free credit report every 12 months from the three nationwide consumer credit reporting companies - Equifax, Experian and Trans Union. You can request your copy by phone or by regular (snail) mail. If you plan do make any mail inquiries to the above mentioned credit reporting companies, I strongly suggest doing it by certified mail with a return receipt requested. Inquiries have a tendency to get lost in the shuffle. Using certified mail with a return receipt request requires the receiver to sign for the letter. You will receive that sign request back. If your inquiry suddenly disappears, you have proof. Make it a habit of doing this, especially with issues that are time sensitive. Cover all your bases.

Second, if picking a fight with Equifax, Experian and Trans Union seems daunting to you, please hire a credit repair lawyer. There are reputable lawyers in your area that are experienced in disputing negative items on your credit report. This is my personal weapon of choice. Yes, it will cost you some money. Nevertheless, the rewards of obtaining a sterling (and true) credit report outweighs the cost.

Before you go hunting for a credit repair attorney, be forewarned. There are unsavory individual and companies who make fantastic claims of "magically" erasing all your debt. When the rubber meets the road, no results are forthcoming. Some of these companies may try to tempt you to change your Social Security number or get an Employer Identification number (EIN) to create a new credit report. Do not fall for this scam! This is ILLEGAL! You could be prosecuted for mail or wire fraud if you use mail or telephone to provide false information to apply for a credit or a loan. It is serious federal crime to make false statements on a loan or credit application, to give false Social Security Number, and to deceitfully obtain an Employer Identification Number from the Internal Revenue Service.

Now for the fun stuff!

You may find that many of the debts within your credit report are not yours or were not dropped off after the time limit set forth by federal law. We will deal with the latter of the two.

Time Limits

You or your attorney will concentrate on these ten negative items on your credit report. If any of these are past the time allotted by Federal law, it can be disputed. The creditor has 30 days to provide proof that the negative is valid. If the creditor fails to do so, the disputed negative item must come off.

  • Bankruptcy: Ten years from the date of discharge for chapters seven, eleven and twelve. Seven years for chapter thirteen. Any accounts covered by the bankruptcy stay on individual's report for seven years.
  • Delinquencies: Seven years from the first missed payment or original delinquency date.
  • Collections: Seven years from the original delinquency date.
  • Charge offs: Seven years from the original delinquency date, no matter if late payments were made. NOTE: The original creditor can sell your debt to a collection agency if they feel they won't get a cent from you in the near future. Some collectors claim that by making a payment or contacting them, an individual has reset the time limit to zero. This is not true! This practice is called "reaging". The Federal Trade Commission (FTC) has declared reaging invalid.
  • Lost Credit Card: Two years with no delinquencies. Seven years with delinquency.
  • Child Support: Seven years from date the judgment is filed.
  • Closed Accounts: Seven years from date of closing with delinquencies.
  • Child Support: Seven years from date judgment is rendered.
  • Liens: Fifteen years for unpaid tax liens. Seven years for paid liens.
  • Credit Inquiries: Two years.
  • Small Claims and Civil Judgments: Seven years from date judgment is rendered.
  • Paid Positive Accounts: Ten years.
  • Positive Credit Data: No time limit.

Depending on the extent of damage on your report, a thorough credit repair should take between three to six months from start to finish. Do not expect the credit reporting agencies to make this process easy for you or your lawyer. Above all, DO NOT apply for credit in any way or form during this time.

Be patient, stick to your guns and the prize will be yours.

The truth? Not only is credit repair legal...it's actually guaranteed by law. Why? Because the FCRA provides you the right to have a COMPLETELY accurate credit report, and often the smallest inaccuracies are responsible for removing the very WORST things on your report! (even if by and large...they are pretty much true)

The bottom line?

Credit repair is legal, ethical and 100% within your rights. If anyone tells you anything otherwise....they either AREN'T telling you the truth, don't know the facts, or have a reason for misrepresenting the facts. (no lie!)
